Any person outside his country of origin and while in Mexican territory has the right to apply for refugee status and must present his / her claim before the National Institute of Migration or COMAR.
Once the application is admitted, the applicant has the right of non refoulment. The principles of confidentiality and non discrimination are also applied.
The claimant must complete a questionnaire and be interviewed by COMAR representatives. During the interview, the applicant must explain the base of his / her claim, as well as present all other elements relevant to his / her claim. If needed, COMAR will provide the assistance of a interpreter.
COMAR then reasearches country of origin conditions based on information provided by the Ministry of the Exterior and UNHCR when needed.
Taking into account the elements provided by the claimant during the interview, as well as the information regarding county of origin conditions, COMAR elaborates a legal analysis presented to the Committee of Eligibility. The Committee is Presided by the Vice Minister of the Interior with the participation of a representative of the Ministry of Foreign Relations, the Ministry of Labor, the National Immigration Institute and COMAR.
The Committee meets periodically and analyses every claim on the basis of the recommendation made by COMAR. In turn, the Committee makes a recommendation to the National Institute of Migration regarding the approval or denial of recognition of refugee status.
Once the Committee has made a recommendation, the National Institute of Migration must elaborate a founded resolution regarding the outcome of the claim. The claimant who is recognized as a refugee will be documented as such. The claimant whose application is not accepted has the right to challenge such decision before the National Institute of Migration.
